ACFS Privacy Policy

PRIVACY - PROTECTION OF INFORMATION

Please read carefully before you agree to this. Where there is more than one applicant, separate declarations must be signed. We will only collect information relevant to our business relationship with you. This information is collected directly from you and from sources as outlined below.


DECLARATION BY THE CREDIT PROVIDER
AUSTRALIAN CAPITAL FINANCIAL SERVICES PTY LTD

You are informed that, under Section 18 (E) (1) of the Commonwealth Privacy Act 1988, a lender may request personal information about an applicant from a credit reporting agency for the following purpose:

  • To obtain a consumer credit report about you, and

You are also informed that, under Section 18 (N) of the Commonwealth Privacy Act 1988, a credit provider that is in possession or control of a report and or personal information may disclose that report to a credit reporting agency to:

  • Allow the credit reporting agency to create or maintain a credit information file containing information about you.

We use your personal information to:

  • Help us process your application for one or more of our services;
  • Efficiently manage and administer all services we provide to you;
  • Ensure both you and our company fulfill all our legal requirements.

We may disclose your personal information to:

  • Our external service providers and their agents, that provide business services to us, on a confidential basis only for the purpose of our business;
  • Any complaints body to which a complaint, relating to a particular service we provide to you, is referred
  • Any court or tribunal as may be required by law.

The information is limited to:

  • Identity particulars - your name, sex, address (and previous two addresses), date of birth, name of employer and drivers' licence number.
  • Your application for credit or commercial credit - the fact that you have applied for credit and the amount.
  • The fact that Australian Capital Financial Services is a current credit provider to you.
  • Loan repayments which are overdue by more than 60 days, and for which debt collection has started.
  • Advice that your loan repayments are no longer overdue in respect of any default that has been listed.
  • Information that, in the opinion of Australian Capital Financial Services, you have committed a serious credit infringement (i.e. you have been fraudulent or show an intention not to comply with your credit obligations).
  • Dishonoured cheques - cheques drawn by you for $100 or more, which have been dishonoured more  than once.
  • That credit provided to you, by Australian Capital Financial Services, has been paid or otherwise discharged.


Period to which this understanding applies:

  • This information may be given before, during or after the provision of credit to you.

STATEMENT BY APPLICANT AND DECLARATION

1.    Consent to the use of my personal information in connection with the Application for a Credit Facility

By applying to Australian capital Financial Services Pty Ltd (ABN 21 099 366 211) (“ACFS”) I am and will be disclosing personal information about me and other persons (such as my spouse/partner) to Cash Stop Financial Services Pty Ltd (the Introducer/Broker) as well as to ACFS, I acknowledge that this personal information, and any other personal information the Introducer/Broker and or ACFS collects about me (“my personal information”) will or may be used by the Introducer/Broker to make my application to ACFS for the credit facility (“Credit Facility’) I acknowledge that where such an application is made  to ACFS, ACFS will use my personal information to enable it to assess my application for a Credit Facility and if my application is approved, for the subsequent administration of the Credit Facility.

I consent to the Introducer/Broker and separately to ACFS (and each of it’s related companies) using and disclosing my personal information for this purpose and acknowledge that without this information the Introducer/Broker may be unable to process and ACFS may be unable to process or accept my application or to operate or administer the Credit Facility.

2.     Disclosure of my Personal Information

I understand that ACFS and each of it’s related companies, may disclose my personal information, and any other information they collect about me, to each other and to the Applicant or directors of the Applicant to the Introducer/ Broker, credit reporting agencies; other financial institutions and credit providers; service providers; other entities to whom ACFS or its related companies is required by Law, or authorised by me to disclose my personal information, and subject to the Privacy Act 1988 (the “Privacy Act”) and the terms of this Notice, I consent to any such disclosures regardless of how or when that information was collected.

I consent to the Introducer/Broker or ACFS disclosing my personal information to any employer named in my application for the Credit Facility to verify information I have provided in respect of that application. I also consent to any such employer disclosing information to the Introducer/Broker and or ACFS for the purpose of verifying that information.

3. Other consents relating to the assessment of my credit capacity

If and to the extent that the Introducer/Broker or ACFS does so in a manner and for the purposes that conform with the Privacy Act: (a) I agree to the Introducer/Broker or ACFS obtaining information about my commercial activities and commercial credit worthiness from a business which provides information about the commercial credit worthiness of persons, and to the Introducer/Broker or ACFS using that information in assessing my application for credit; and (b) I also agree to the Introducer/Broker or ACFS giving and receiving from any credit providers named in the Application, information about my credit arrangements, provided that the information is given or received to assess an application for credit made by me to the recipient credit provider or to assess my credit worthiness or to notify the other credit provider of a default by me; and (c) I also agree to the Introducer/Broker or ACFS obtaining a credit report containing my personal information about me from a credit reporting agency and to the Introducer/Broker or ACFS  using that report or information derived from the report in assessing this application and to ACFS using the report to collect payments overdue under any Credit Facility granted to me, by  ACFS, and for any other purpose permitted under the Privacy Act.
I also acknowledge that, subject to the provisions of the Privacy Act, the Introducer/Broker or ACFS may otherwise disclose to any other person any information concerning a credit facility granted to me or the conduct of that credit facility.

4. Access to Information provided to ACFS

Subject to the provisions of the Privacy Act, I acknowledge that I may have access to my personal information collected and held by the Introducer/Broker or ACFS (and it’s related companies). I acknowledge that I can enquire as to my personal information by contacting either the Introducer/Broker or ACFS.

5.     Breach of Contract

In the event of any breach by me of any Credit Facility Contract I may enter into, with ACFS, on the date below or thereafter. I hereby agree that any information provide by me, to ACFS, shall be made available to authorised personnel
employed by the solicitors and/or debt collection agencies, authorised by ACFS and associated in the process of recovery of the credit facility amount, interest (if any), fees (if any) and all legal and administrative costs incurred.
